This privacy policy (“Privacy Policy”) applies to you, the User (“you”, “your” or “User”), and Your access to and/or use of the website FANCONTENT.COM (the “Website”) and the software platform and services provided thereon (the “Services” and together with the Website, the “FanContent Platform”) owned and operated by Fan Leads Inc. (“Fan Leads,” “we,” “us,” or “our”). The Effective Date of this Privacy Policy is the date first set forth above. Capitalized terms not defined in this Privacy Policy will have the meaning set forth in our Terms of Use.
We have created this Privacy Policy to tell You what information we collect, how that information is used, and with whom that information is shared (if at all). This Privacy Policy does not address the privacy practices of any third parties that we do not own, control, or are affiliated with. By registering as a User of the FanContent Platform and in connection with Your access to and/or use of the FanContent Platform, You are agreeing to the terms of this Privacy Policy and expressly consent to the collection, storage, use and disclosure of Your Personal Information as described in this Privacy Policy. We encourage you to read the Privacy Policy, and to use the information it contains to help you make informed decisions.
1. Information We Collect or Receive
In the course of providing the FanContent Platform, we may collect and/or receive, and You hereby authorize us to collect, receive, store, and transfer, the following types of information.
(a) Personal Information. We only receive or collect information that identifies You personally if You choose to provide such personally identifiable information to us as part of Your access to and/or use of the FanContent Platform. When You sign up to become a User or contact us, You will be required to provide us with personal information about Yourself (collectively, the “Personal Information”). Such Personal Information may include Your name, e-mail address, physical address, and phone number. We may have to request verification of this Personal Information by submission of documents such as Identification documents (Driver’s License, Passport) and proof of address (Utility bill, bank statement)
(b) Payment Information. As a User of FanContent, you may be required to provide us with Your payment information, including, without limitation, Paypal account ID, bank account numbers, credit card or debit card numbers, account details, ACH information, and similar data (collectively, “Payment Information”). Such Payment Information will be collected and processed by our third-party payment vendors pursuant to the terms and conditions of their privacy policies and terms of use.
(c) Geolocational Information. Access and usage of FanContent may be restricted based on your location. In order to verify that your usage of FanContent respects these restrictions, we may, automatically collect geolocational information from Your computer, Your mobile device or wireless carrier and/or certain third-party service providers (collectively, “Geolocational Information”). Collection of such Geolocational Information occurs only when the FanContent Platform are running on Your computer or mobile device. You may decline to allow us to collect such Geolocational Information, in which case you may not be able to use the FanContent Platform.
(d) Third-Party Analytics. We and the third-party technology providers with which we work use third-party analytics services (e.g., Google Analytics) to evaluate Your use of FanContent, compile reports on activity, collect demographic data, analyze performance metrics, and collect and evaluate other information relating to use of the FanContent Platform. These third parties use cookies and other technologies to help analyze and provide us the data. You consent to the processing of data about You by these analytics providers in the manner and for the purposes set out in this Privacy Policy. Please be advised that if You opt out of any such service, You may not be able to use the full functionality of FanContent Platform.
(e) Other Information. In addition to the Personal Information, Payment Information, and Geolocational Information, we may automatically collect or receive additional information regarding You and Your use of the FanContent Platform; Your interactions with us; and information regarding Your computer and mobile devices used to access the FanContent Platform (collectively, the “Other Information”). Such Other Information may include:
i. From You. Additional information about Yourself that You voluntarily provide to us, such as Your product and/or service preferences.
ii. From Your Activity. We may collect or receive information regarding:
A. IP address, which may consist of a static or dynamic IP address and will sometimes point to a specific identifiable computer or mobile device;
B. browser type and language;
C. referring and exit pages and URLs;
D. date and time; and
E. details regarding Your activity on the FanContent Platform, such as search queries and other performance and usage data.
iii. About Your Computer/Mobile Device. We may collect or receive information regarding:
A. type of computer or mobile device;
B. operating system and version (e.g., iOS, Android or Windows);
C. carrier or internet service provider; and
D. network type (WiFi, 3G, 4G, LTE).
iv. From Cookies. We may use both session cookies, which expire once You close the FanContent Platform, and persistent cookies, which stay on Your computer or mobile device until You delete them, and other technologies to help us collect data and to enhance Your experience with the FanContent Platform. Cookies are small text files which can be used to recognize a repeat visitor to the FanContent Platform. We may from time to time engage third parties to track and analyze non-personally identifiable usage and volume statistical information from visitors to our Website to help us administer our Website and improve its quality. Such third parties may use cookies to help track visitor behavior. Such cookies will not be used to associate individual website visitors to any personally identifiable information. We may use cookies for various purposes, including to:
A. identify type of computer or mobile device;

C. analyze which portions of the FanContent Platform are visited, accessed, and used most frequently; and

2. How Information is Used and Shared
(a) You authorize us to use the Personal Information, Payment Information, Geolocational Information, and the Other Information (collectively, the “Information”) to:
i. provide access to and use of the FanContent Platform and to provide promotional and non-promotional information about and improve performance and functionality of the FanContent Platform;
ii. solicit Your feedback; and
iii. internal record keeping and statistical analysis.
(b) In order to provide the FanContent Platform and administer our promotional programs, we may share the Information with our third-party promotional and marketing partners, including, without limitation, businesses participating in our various programs.
(c) We may engage third-party companies and individuals to perform functions on our behalf. Examples may include providing payment processing, technical assistance, customer service, marketing assistance, and administration of promotional programs. These other companies will have access to the Information only as necessary to perform their functions and to the extent permitted by law
(d) In an ongoing effort to better understand our users and the FanContent Platform, we may analyze certain Information in anonymized and aggregate form to operate, maintain, manage, and improve the FanContent Platform. This aggregate information does not identify You personally. We may share and/or license this aggregate data to our affiliates, agents, business and promotional partners, and other third parties. We may also disclose aggregated user statistics to describe the FanContent Platform to current and prospective business partners and investors and to other third parties for other lawful purposes.
(e) We may share some or all of Your Information with any of our parent companies, subsidiaries, joint ventures, or other companies under common control with us.
(f) As we develop our businesses, we might sell or buy businesses or assets. In the event of a corporate sale, merger, reorganization, sale of assets, dissolution, or similar event, the Information may be part of the transferred assets. In addition, the Information may be transferred as part of a disposition of assets through a bankruptcy or similar proceeding.
(g) To the extent permitted by law, we may also disclose the Information: i) when required by law, court order, or other government or law enforcement authority or regulatory agency or legal process; ii) whenever we believe that disclosing such Information is necessary or advisable, for example, to protect the rights, property, or safety of us or others, including You; or iii) whenever we believe that Your actions are, or appear to be, in violation of this Privacy Policy or our Terms of Use Agreement and we believe that disclosing such Information will assist in our efforts to enforce the terms of this Privacy Policy or our Terms of Use Agreement.
(h) In the process of using the FanContent Platform as intended, certain Information may be disclosed to others, including:
i. Your user ID, username, rating, city, and profile fields which You have chosen to fill out;
ii. Your contact information (name and email address and postal address) to third party payment processors in order to complete the transaction; and
iii. other Information that You choose to submit to a public forum on the FanContent Platform, or in any Content Order, or which you include in any Submitted Content.
For any Information that You have voluntarily disclosed in a public forum on the FanContent Platform, in any Content Order, or in any Submitted Content, we have no control over how that Information is used and we are not responsible for the subsequent handling or use of any information You choose to voluntarily disclose. You should discuss any privacy concerns You may have with any person You meet through or in connection with Your use of the FanContent Platform as the only protection You will have is whatever terms You agree to directly with the transacting party. We make no representations regarding, and disclaim all liability arising out of, or related to, the accuracy or completeness of the Information We collect and disclose in connection with the FanContent Platform
3. Accessing and Modifying Information and Communication Preferences
If You have provided us any Personal Information, You may access, remove, review, and/or make changes to the same by contacting us as set forth below. Generally, we will not manually modify Your Personal Information because it is very difficult to verify Your identity remotely. You may also access, remove, review, and/or make changes to any of Your Personal Information by logging into Your account for the FanContent Platform although Your ability to use some of Services or features of the FanContent Platform may be affected. You must promptly update Your Personal Information if it changes or is inaccurate.
In addition, You may manage Your receipt of marketing and non-transactional communications by clicking on the “unsubscribe” link located on the bottom of any of our marketing e-mails. We will use commercially reasonable efforts to process such requests in a timely manner. You should be aware, however, that it is not always possible to completely remove or modify information in our subscription databases. We reserve the right to send out and You cannot opt out of receiving transactional or non-promotional e-mails related to the FanContent Platform. We may also deliver notifications to Your mobile device (e.g., push notifications). You can disable these notifications by deleting the relevant service or by changing the settings on Your mobile device.
Upon Your written request, we will close Your account and remove Your Personal Information from view as soon as reasonably possible based on Your account activity and in accordance with applicable law. We do retain Personal Information from closed accounts to comply with law, prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigations, enforce this Privacy Policy or our Terms of Use Agreement, and to take other actions otherwise permitted by law.
4. How We Protect Your Information
Your account is protected by a password. We recommend using unique numbers, letters and special characters for Your password, and not disclosing Your password to anyone. If You do share Your password or Your Personal Information with others, remember that You are responsible for all actions taken in the name of Your account. If You lose control of Your password, You may lose substantial control over Your Personal Information and may be subject to legally binding actions taken on Your behalf. Therefore, if Your password has been compromised for any reason, You should immediately notify us and change Your password.
We will retain Your Information for as long as Your account is active or as needed to provide You with access to the FanContent Platform. Your Information is stored on our servers located in the United States. We take commercially reasonable steps to protect the Information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. Please understand, however, that no security system is impenetrable. We cannot guarantee the security of our databases or the databases of the third parties with which we may share such Information, nor can we guarantee that the Information You supply will not be intercepted while being transmitted over the Internet or that other users may abuse or misuse Your Information that they collect from the Website. In particular, e-mail sent to us may not be secure, and You should therefore take special care in deciding what information You send to us via e-mail. The FanContent Platform and our servers are operated in the United States. Our online privacy practices are governed by the laws of the United States and the State of Nevada, which may differ from privacy laws in Your state or home country.
If You are located outside of the United States, please be aware that Your Information, including Your Personal Information, may be transferred to, processed, maintained, and used on computers, servers, and systems located outside of Your state, province, country, or other governmental jurisdiction where the privacy laws may not be as protective as those in Your jurisdiction. If You are located outside the United States and choose to use the FanContent Platform, You hereby expressly, irrevocably and unconditionally consent to the transfer to and from, processing, usage, sharing, and storage of Your information in the United States and such other jurisdictions as set forth in this Privacy Policy.
If You are a data subject in the European Economic Area (“EEA”), You have the right to access, rectify, or erase any Personal Information we have collected about You through the FanContent Platform. You also have the right to data portability and the right to restrict or object to our processing of Personal Information we have collected about You through the FanContent Platform. You may withdraw Your consent at any time for any data processing we do based on consent You have provided to us.
To exercise any of these rights, contact our Customer Service and specify which right You intend to exercise. We will respond to Your request within 30 days. We may require additional information from You to allow us to confirm Your identity before granting You the requested access. To the extent permitted, a charge may apply before we provide You with a copy of any of Your Personal Information that we maintain
Please note that we store information as necessary to fulfill the purposes for which it was collected, and may continue to retain and use the information even after a data subject request for purposes of our legitimate interests, including to comply with our legal obligations, resolve disputes, prevent fraud, and enforce our agreements. If You have any issues with our compliance, You may have the right to lodge a complaint with an EEA government regulator if You are not satisfied with our response.
6. Notice to California Customers; “DO NOT TRACK” (DNT) Notice
Subject to certain limits under California law, California residents may ask us to provide them with (1) a list of certain categories of personal information we have disclosed to third parties for their direct marketing purposes during the immediately preceding calendar year and (2) the identity of those third parties. To obtain this information, please mail You request to the address noted below. Requests must include “California Shine the Light Privacy Request” in the first line of the description and include Your name, street address, city, state, and ZIP code. Please note that we are not required to respond to requests made by means other than through the provided mail address.
California law requires us to let You know how we respond to web browser Do Not Track (DNT) signals. Because there currently is not an industry or legal standard for recognizing or honoring DNT signals, we don’t respond to them at this time. We await the result of work by the privacy community and industry to determine when such a response is appropriate and what form it should take.
7. Notice to Nevada Customers
Nevada law (SB 220) requires website operators to provide a way for Nevada consumers to opt out of the sale of certain information that the website operator may collect about them. We do not sell your Personal Information to third parties as defined in Nevada law, and will not do so in the future without providing You with notice and an opportunity to opt-out of such sale as required by law. The Website may contain links to third-party websites. We have no control over the privacy practices or the content of these websites. As such, we are not responsible for the content or the privacy policies of those third-party websites. When You visit or interact with the FanContent Platform, we or our authorized service providers may use cookies, web beacons, and other similar technologies for storing information to help provide You with a better, faster, and safer experience and for advertising purposes.

They are either necessary for the functioning of the FanContent Platform, help us improve our performance, or give You extra functionalities. We use cookies and similar technologies that only remain on Your device for as long as You keep Your browser active (session) and cookies and similar technologies that remain on Your device for a longer period (persistent). If a person under the age of 18 has provided us with Personal Information, a parent or guardian of that person may contact us and request that such information be deleted from our records.

This Privacy Policy is effective as of the date stated at the top of this Privacy Policy. We may change this Privacy Policy from time to time. Any such changes will be posted on the Website and effective immediately upon posting of the revised Privacy Policy.
